1. HOW TO ENTER:
The Food Lion "The Ultimate Race Fantasy" Sweepstakes (the "Promotion") begins at 12:01 AM ET on April 9, 2008 and ends at 11:59 PM ET on May 6, 2008 (the "Promotion Period"). There are two methods of entry:
- Visit a participating Food Lion grocery store in the states of DE, FL, GA, MD, PA, TN, WV, KY, NC, SC, VA and District of Columbia ("DC"), and each time you purchase any participating products and present your MVP Card and Opt-in Card (available in the Food Lion weekly circular), you are automatically entered. Participating products include any items from the following brands: Coca-Cola, ConAgra Foods, General Mills, Gillette Fusion, Kellogg, Ragu, and Unilever Foods. Limit one entry per Opt-in card/MVP Card account per transaction. Each automatic entry must be received by 11:59 PM ET on May 6, 2008 to be eligible for the random drawing.
- To enter without making a purchase, hand-print your full name, street address (no P.O. Boxes), city, state, zip code, date of birth (mm/dd/yyyy), plus daytime and evening telephone numbers on a 3" x 5" card. (If you do not have a telephone, indicate "No Phone." Failure to comply with this or any other Official Rule will result in disqualification.) Mail your entry in a postage-paid business-size (#10) envelope, postmarked by May 6, 2008 and received by May 12, 2008, to: Food Lion "The Ultimate Race Fantasy" Sweepstakes, 625 Panorama Trail, Bldg. 2, Suite 100, Rochester, NY 14625. No mechanically reproduced entries will be permitted. You may use the mail-in option as often as you like, but each entry must be hand-printed and mailed separately. Sponsor not responsible for electronic, network or computer/scanner failures or malfunctions, cards scanned incorrectly, or other technical errors of any kind. Sponsor assumes no responsibility for lost, late, incomplete, illegible, damaged, misdirected or postage-due mailed entries.
2. ELIGIBILITY
Open only to residents of the states of DE, FL, GA, MD, PA, TN, WV, KY, NC, SC, VA and DC, who are 18 years old or older as of April 9, 2008. Employees of Food Lion and its "Promotional Participants" (i.e. The Coca Cola, ConAgra Foods, General Mills, Gillette Fusion, Kelloggs, Ragu, Unilever Foods, The Coca-Cola Company, Lowe's Motor Speedway, NASCAR, and each of their respective affiliates, subsidiaries, advertising and promotion agencies and suppliers involved in this promotion) and the immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, half-sister, as well as any of the immediate family members and/or those living in the same household as any of the aforementioned (whether related or not), are not eligible to participate.
3. DRAWING
Winners will be selected in a random drawing to be held on or about May 12, 2008, under the supervision of an Independent Sweepstakes Administrator, from among all eligible entries received. All decisions of the Independent Sweepstakes Administrator and the Sponsor are final. Winners will be notified by phone and confirmed in writing. If a potential winner cannot be contacted within two (2) business days, that individual may be disqualified and an alternate winner selected at random from among all of the remaining eligible entries. Limit one (1) prize per name, address and/or household.
4. ODDS
Odds of winning are dependent on the number of eligible entries received.
5. PRIZES
There is one (1) Grand Prize. The Grand Prize consists of The Ultimate Race Fantasy for the Grand Prize winner and five (5) guests for the weekend of Friday, May 23, 2008 - Monday, May 26, 2008. Grand Prize includes: Platinum VIP all access for six (6) to Food Lion Speed Street consisting of: meet and greet with the Sponsor-specified bands and drivers of Food Lion Speed Street; VIP access to the Coca-Cola 600 race on May 24 and May 25, 2008 at Lowe's Motor Speedway in Concord, NC consisting of: six (6) Suite tickets to the Race, six (6) pit passes/tour at the Race (any winner's guest under the age of 18 at the time of the Race will not be permitted access to the pit tour areas. Certain dress requirements (closed toe shoes, long pants, sleeved shirts, etc.) apply for pit tour areas); a ride in a pace car around the track at the Lowe's Motor Speedway in the Coca-Cola 600 Parade for Grand Prize winner only; the Grand Prize winner will join the Coca-Cola 600 winner in the Winner's Circle after the race; three nights hotel accommodations (three rooms, double occupancy, for May 23, 2008 through May 26, 2008) at a Sponsor-specified hotel, transportation for six (6) to Race/Hotel in a Stretch Hummer Limousine and a $2,500 travel stipend awarded in the form of a check to the Grand Prize winner only. Transportation from winner's and winner's guests' homes to event weekend is not included as part of prize. Winner must be able to travel to Concord, NC on May 23, 2008, stay through race day on the May 25, 2008, and depart on May 26, 2008, or prize will be forfeited and an alternate winner selected. Approximate Retail Value (ARV) of this trip is $13,000. Prize is not transferable to another individual, nor may it be sold (in sum or in part). All other travel expenses not specifically mentioned herein, including but not limited to; telephone, food & beverages, in-room services, gratuities, local ground transportation, and taxes, are the responsibility of the winner to pay. If the Race is delayed, postponed or cancelled for any reason, winner will not receive tickets as part of prize, but tickets may be subject to standard rain-check policies and procedures established by issuer.
There are five (5) First Prizes - Each First Prize consists of one (1) certificate for the Richard Petty Driving Experience at Lowe's Motor Speedway in Concord, NC, which entitles the winner to drive for eight (8) laps around the Lowe's Motor Speedway in a 358 cubic inch V-8 NASCAR style racecar with 600 horsepower. Prize awarded in the form of a certificate valid for the year of 2008. ARV: $359.00 each. Transportation not included as part of prize. Winner must have a valid driver's license. All standard NASCAR, Inc. rules and regulations apply. Prizes consist of only those items specifically listed as part of prize.
All federal, state and local taxes on any prize are the sole responsibility of the prizewinner. Winners will be issued an IRS Misc. Income 1099 tax form for the total value of the prize. Prizes cannot be transferred, or substituted. All prizes will be awarded. Total value of prizes to be awarded: $14,795.
6. GENERAL CONDITIONS
By participating in this sweepstakes, participants agree (a) to be bound by these Official Rules; and (b) that the decisions of Sponsor are final on all matters relating to this promotion. Prize Winners will be required to complete, execute and return an Affidavit of Eligibility and a Publicity/Liability Release within three (3) days of notification. Noncompliance, failure to return documents with three (3) days, or prize notification being returned as non-deliverable, may result in disqualification and prize forfeiture. Winners grant to Sponsor, its parent company, subsidiaries, affiliates and those acting pursuant to its authority, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's name, address (city & state), portrait, picture, voice, likeness and biographical information for advertising and promotional purposes without additional consideration, unless prohibited by law. By accepting the prize offered, winners agree to release and hold harmless the Sponsor, its parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all actions and/or liabilities for any injuries, loss or damage of any kind to person, including death or disability, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, prize related activity, or participation in this sweepstakes. Sponsor is not responsible for any typographical or other error in the printing, the offering or the announcement of any prizes or in the administration of the promotion, and reserves the right to modify these rules if necessary. Sponsor is not responsible for lost, late, delayed, incomplete, illegible, mutilated or misdirected entries, postage due mail, entries not received in time for random drawing or for electronic, network or computer/scanner failures or malfunctions, cards scanned incorrectly, or other technical errors of any kind. Sponsor reserves the right to cancel or modify the frequent shopper entry portion of the sweepstakes if fraud, misconduct or technical failures destroy the administration, security, or proper administration of the program as determined by Sponsor and/or the Independent Sweepstakes Administrator, in their discretion. If the frequent shopper entry portion is so cancelled, a random drawing will be conducted from among all eligible frequent shopper card and mailed entries received up to the point of cancellation. All entries will have an equal chance of winning. In the event a potential winner entered via a Food Lion MVP Card and a dispute arises regarding the specific individual entitled to receive a prize, entries made via the Food Lion MVP Card will be declared made by the authorized/primary account holder. Participant may be requested to provide Sponsor with proof that the participant is the authorized/primary account holder of the Food Lion MVP Card associated with the account.
7. CHOICE OF LAW
This sweepstakes is governed by the laws of the state of North Carolina, without regard to conflict of law doctrine. By entering the sweepstakes, all participants agree to be subject to jurisdiction in the Federal and State courts of North Carolina and agree that all disputes relating in any way to this sweepstakes must be resolved in the Federal and State courts of North Carolina.
